These terms govern your use of the AcheNest app. By downloading or using AcheNest, you agree to them. Please read the medical disclaimer carefully.
Not medical advice
AcheNest is a personal tracking tool, not a medical device. It does not diagnose, treat, cure, or prevent any condition, and nothing in the app is medical advice. Always consult a qualified health professional about your symptoms. If you are experiencing a medical emergency, such as chest pain, difficulty breathing, fainting, sudden weakness or confusion, stroke-like symptoms, severe abdominal pain, or heavy bleeding, contact your local emergency services immediately.
Licence
Jerome Coloma grants you a personal, non-exclusive, non-transferable, revocable licence to use AcheNest on devices you own or control, for your own personal symptom tracking. You may not copy, modify, reverse engineer, resell, or redistribute the app except as permitted by applicable law or the app store terms you obtained it under.
Your data and your responsibility
AcheNest stores your record only on your device and never uploads it. You are responsible for keeping your device secure and for keeping your own encrypted backups. Because we hold no copy of your record and no backup passphrase, we cannot recover data that is lost when a device is lost, reset, or uninstalled, or when a passphrase is forgotten. See the Privacy Policy for how your information is handled.
Acceptable use
Use AcheNest lawfully and only for its intended purpose. Do not use it in any way that could harm the app, other people, or that violates applicable law.
No warranty
AcheNest is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the app will be uninterrupted, error free, or that any pattern it surfaces is accurate or clinically meaningful.
Limitation of liability
To the maximum extent permitted by law, Jerome Coloma will not be liable for any indirect, incidental, special, or consequential damages, or for any loss of data, arising from your use of or inability to use AcheNest. Nothing in these terms limits rights you have under consumer protection laws that cannot be excluded, including the Australian Consumer Law.
Changes
We may update these terms as the app evolves. Changes will be posted here with a revised date. Continuing to use AcheNest after a change means you accept the updated terms.
Governing law
These terms are governed by the laws of Australia. Your use of the app is also subject to the terms of the app store you obtained it from.
